Wow, I was sure that he was going to be indicted. Good decision. Unfortunately he is still subject to wrongful death suit by the dead robber’s family.

The article didn't say if Ogg was recommending charges... looks like my guess was true... Soros DA didn't want accountability on this one she let the defender go. Quanell X won't be happy, but is he ever?

Unless I'm miss-reading this, I don't think he will be.

Sec. 83.001. Civil Immunity.

A defendant who uses force or deadly force that is justified under Chapter 9, Penal Code, is immune from civil liability for personal injury or death that results from the defendant’s use of force or deadly force, as applicable.

I do not believe this statute was in effect at the time this incident occurred. Thats actually a good lawyer question, does an exemption like this count from when a no-bill or grand jury decision is decided, or only on incidents from the effective date forward? Its a weird timing thing for sure.

Also, I'm pleasantly surprised he was no billed. Either in the thread I stated I thought he would be found guilty of **SOMETHING** for that last shot at least, but this is surprising considering the DA and location.

His actions don't meet up with the standards of professional decorum for those who are paid to carry in some form, but its good to know criminally that once Chapter 9 is hit, we're pretty much covered to end the threat. Obviously the grand jury was convinced that he did not believe the threat was ended.

Correct. It's been that way since I began teaching LTC in 2012. I never paid attention to what date it was enacted, but according to the statue link you posted it was first put into the Civil Code in 1995, then amended in 2007.

But, to be clear, this doesn't prevent anyone from bringing a civil suit against him; it just establishes that if they do sue him that he owes them nothing in damages. And since most civil attorneys work on a retainer for a percentage of the jackpot, it likely will limit how many will be jumping on the bandwagon for a percentage of $0.00.

And if they did bring a civil suit, I would imagine the judge would dismiss it outright when the defense brings up Sec 83.001

All I have to go on is the video. To me, it looked like the customer was in the clear from a self defense perspective, until the final shot... I thought that was pretty clearly outside the lines of self defense...

Not a lawyer and I don't have all the facts, just the video.

Quanell says it's self defense. That defense line is about as lame as lawyer Allen Tanner's 'Rap defense' for the murder of state trooper Bill Davidson in 1992 by a thug whose name I refuse to include. Tanner's ridiculous use of rap music being the inspiration for murder was a failure and the murderer was finally executed October 6, 2005. I hope these thugs get the same sentence.

No firearm discharged that I can tell--though the one identified perpetrator did threaten to "shoot up" his old workplace--so maybe this doesn't belong here at all. But, you know, because among large counties nationwide Harris County ranks #3 in "worst drunk-driving problem," this gives a whole new meaning to, "Here, hold my beer":

One man is in jail and three others are wanted by police after they were accused of stealing $675,000 worth of beer. The beer was taken from the Jaguar Transport warehouse in northeast Houston.

Christopher Gray was charged with theft and engaging in criminal activity. The theft appears to have begun in 2022, when Gray was working for a third-party trucking company that was hired to transport beer from the warehouse.

In 2023, police say three warehouse employees started hiring him to move expired beer to another warehouse and to several clubs. The beer was supposed to be returned to the manufacturer to be destroyed. That year, police say all four men stole 375 pallets of beer worth a combined $675,000.
Regarding Harris County's DUI stats:
  • Share of total driving fatalities involving a drunk driver: 46%
  • Drunk-driving fatality rate: 4.1 per 100k
  • Total drunk-driving fatalities (last 5 years): 964
  • Total traffic fatalities (last 5 years): 2,102
Number one in the nation for large counties by share of total driving fatalities involving a drunk driver is El Paso County; #2 is Hidalgo County; #4 is Travis County; #5 is Tarrant County; #6 is Bexar County; #7 is Collin County; #8 is Dallas County; #9 is Denton County; and it isn't until we get to #10, New Haven County, Connecticut, that we move out of Texas.

One of the few things I'm not proud of Texas for. :???:

Interesting question for lawyers would be "if the beer was expired and was to be returned to the brewery to be destroyed, how much value did it actually have"? Who bears the (financial) responsibility for the beer not being retailed before the expiration date? Distributor (warehouse) or brewery?
